Section 59.1


59.1(1) A complainant, if any, may attend a hearing held pursuant to section 58 or 59 in its entirety, or in part, with or without counsel, and may make a written or oral submission, personally or through their counsel, to the Review Committee or the Board of Inquiry.

59.1(2) A complainant attending a hearing held pursuant to section 58 or 59 shall not be considered a party to the hearing and they or their counsel shall not be permitted to call evidence or to examine or cross-examine witnesses.

59.1(3) Notwithstanding subsection(1), at the request of a witness whose testimony is in relation to allegations that a member sexually abused the witness when the witness was a patient of the member, the Review Committee or the Board of Inquiry may exclude a complainant and their counsel from the portion of the hearing that receives the testimony of the witness or any other portion of the hearing that the Committee or the Board considers appropriate to protect the privacy of the witness.
