Review Committee
- Where the Review Committee orders that a member undergo any examination pursuant to Section 58(7)(c)(i) or 58(7)(c)(ii), the Registrar shall cause to be served upon the member notice of the Order, the nature of the examination, and requesting the member to contact the Registrar to arrange for a time and place for the examination.
- Within two weeks of service of the Committee's order on the member, the member shall notify the Registrar whether he will comply with the order of the Committee, and, if he intends to comply, advise whether he wishes to be examined in English or in French and make arrangements with the Registrar for the time, duration and place of the examination.
- All terms of the examination, including those as to time, duration, place or nature of the examination may be modified by the Committee at the request of the member, but all terms at all times shall be within the complete discretion of the Committee.
- Where the member fails to comply with the order, or any term of the order, or where the member fails to notify the Registrar as required by Section 2, the Committee may recommend to Council, without any further hearing, that the licence or specialist's licence, or both, of the member be suspended until the member has complied.
- Upon the Committee reporting its recommendation to Council, the Registrar shall cause to be served on the member and the complainant, if any, a copy of the recommendation of the Committee. The Registrar shall further advise the member that he may address Council regarding the recommendation at the meeting of the Council dealing with the recommendation.
- Upon receiving the recommendation from the Committee, and after affording the member an opportunity to address Council, Council (a) may suspend the licence, or specialist's licence of the member, or (b) if the Chairman of the Committee advises the Council that the member has undergone the examination as stipulated, Council may refer the matter back to the Committee, with such directions it deems appropriate, or reinstate the licence or specialist's licence of the member.
- The suspension of licence and reinstatement of licence referred to in Section 6 shall be effective immediately, or at such later time as Council orders.
- In the case of suspension pursuant to Subsection 6, the Registrar shall cause the Order of Council to be served upon the member.
- An examination shall not be considered to have been completed until the results have been communicated to the Review Committee and the Committee is satisfied that the examination has been completed.
- The College may pay any costs of an examination pursuant to Section 58(7) without prejudice to its rights to recover costs from the member. The member may later be ordered by Council to pay such costs, pursuant to Section 60 of the Act.
- Where the Review Committee requires that a member produce records and accounts pursuant to Section 58(7)(c)(iii) of the Act, the procedure set out in this Regulation for suspension of licence or specialist's licence shall be followed, with all necessary modifications.
- The provisions of this Section apply to all present or future matters before the College.
